Noise Induced Hearing Loss (commonly known as “NIHL”) is the damage to the tiny hair-like cells in the inner ear caused by exposure to loud noises or sounds. These sounds can be for a brief moment (such as an explosion) or a sustained period of time (such as working in a noisy environment every day). The impact of the sounds causes damage to the sensitive structures within the inner ear causing permanent damage to your hearing and/or a ringing noise in your ears.
Who can claim for Noise Indued Hearing Loss?
If you are employed in an environment where there is potential for noise to be above a certain level, then your employer has a common law duty of care to protect you and keep you safe from being subjected to potentially deafening noise. Measures can include: providing hearing protection, regular testing of employees to determine whether there is any damage to their hearing and monitoring workplace noise levels, amongst others.
What type of workplace gives rise to risk of Noise Induced Hearing Loss?
We generally see a large number of industrial employers when bringing claims on behalf of Claimants for Noise Induced Hearing Loss. These include construction, heavy industry, shipbuilding, metalworks, coal mining, road maintenance and so forth. A lot of these workplaces involve use of heavy machinery whereby the employer did not instigate any of the measures mentioned above. The list is not exhaustive, and we do see other occupations whereby employers do not take active protective measures in the belief that noise levels were not loud when in actual fact the noise levels are above those acceptable by law.
